The Statutory Sick Pay (SSP) scheme in Ireland was introduced under the Sick Leave Act 2022 and came into effect on 1 January 2023. It mandates that employers provide paid sick leave to employees, ensuring workers have greater financial security during illness.
As of 1 January 2025, employees are entitled to 7 days of paid sick leave per year, with payments set at 70% of gross earnings, capped at €110 per day. This increase is part of a planned progression, culminating in 10 days of paid sick leave by 2026.
Employers must keep records of sick leave and payments for 4 years and may face fines for non-compliance. The legislation ensures employees cannot be penalised for availing of statutory sick pay and provides avenues for complaints through the Workplace Relations Commission.
To comply, businesses should review employment contracts, adjust payroll systems, and communicate these rights to employees. Employers already offering sick leave that meets or exceeds statutory requirements are considered compliant.
